According to the complaint, Castello alleges that Alkaline’s fraudulent misrepresentation as to its ability to perform under the agreements, its ability to produce products of sufficient quality to meet retailer standards, and its ability to produce products of sufficient quantities for the orders solicited induced Castello to enter into agreements and take actions that materially harmed it causing significant damages to Castello.
